Right-to-Know Request

Upon receipt of a request for public record the Open Records Officer will determine if the record is in the possession, custody or control of the Borough; Determine if the record is presumed to be public or exempted from disclosure; Make a timely written response to the request.

The Borough shall make a good faith effort to respond as promptly as possible under the circumstances existing at the time of the request. The response shall not exceed five business days from the date of receipt of the written request. If it is determined that the request cannot be honored within the initial five business days, a notice will be issued specifying the date when the records may be expected but in no case will the time be longer than thirty additional days. If the Open Records Officer denies a request, the requester can file an appeal with the Office of Open Records within 15 days. The Office of Open Records will review the request and respond with a final determination. Either the requester or Borough can appeal the decision of the Office of Open Records to the Court of Common Pleas.
